Subject : Request for removal of Sh. H. S. Mattewal as Advocate General, Punjab, to ensure free and fair elections in Punjab.

Sir,

The above stated Advocate General Punjab prior to his appointment was advocate for Sh. Prakash Singh Badal now Chief Minister and his son Sh. Sukhbir Singh Badal Dy. Chief Minister Punjab in an ongoing corruption matter pending with a special court at Mohali, Punjab.

After taking over as Chief Minister Sh. Prakash Singh Badal appointed him as Advocate General with an ulterior motive to utilize his services to hush up the corruption matter pending against him and his family. Sh. H. S. Mattewal’s first step as Advocate General was to change the Public Prosecuter in the case by removing Sh. A.P.S. Deol Advocate and appointing Sh. Pradip Mehta Advocate as public prosecutor. Thereafter the prosecution adopted a course to help the accused in the matter, they allowed all important witnesses to resile and the office of Advocate General was misused to pressurize official witnesses to depose and resile in favour of the accused Badal family.

Sensing trouble the corruption matter against the Badal family was taken to the Hon’ble Supreme Court of India for shifting the trial of the case out of Punjab to ensure Justice. Sh. H. S. Mattewal AG has been taking keen interest in protecting the individual interest of the Badal family in the Supreme Court and has been visiting New Delhi on each date. A careful analysis of the log book of Sh. Mattewal would prove my point that when ever there is a hearing in the Badal corruption matter or the cases pending hearing against Capt. Amarinder Singh in the Supreme Court, Sh. Mattewal is always in Delhi which the record of log book would prove beyond doubt.

Also how the AG has been wasting the money of the State public exchequer would become amply clear as he has been engaging high profile private lawyers paying hefty sums running into crores to defend the cases of the State against Capt. Amarinder Singh Ex CM. Although the State of Punjab has many standing counsels in the Supreme Court and can also utilize the services of the Attorney General’s office, yet in order to victimize Capt. Amarinder the resources of the State are being plundered.

How an Advocate General can misuse his authority to legitimize an illegality is amply clear when be recommended the promotion of Sh. Sumedh Saini IPS from IGP to ADGP Punjab Police, in his legal opinion to the State Govt. It is a known fact that Sh. Saini is currently facing trial in an abduction matter in a CBI special court in Delhi and charges have been framed against him in the case. Besides this while legally advising the State Govt. on the promotion matter of Sh. Saini, Mr. H.S. Mattewal AG preferred to ignore two other serious cases pending against the said officer.

To sum it all, the office of Advocate General Punjab has become a centre of political conspiracies and a handy tool against the political opponents of the present Punjab Govt. Therefore in order to ensure free and fair elections in Punjab, it is highly imperative to dispense with the services of the Advocate General of Punjab with immediate effect lest the police and civil administration is misutilized to the advantage of the State Govt.
